This website and online store are operated by Mount Up LLC under the TIME Movement brand. Throughout these Terms of Service, the terms “TIME Movement,” “we,” “us,” and “our” refer to Mount Up LLC and the TIME Movement brand.

TIME Movement provides this website, including its information, content, features, tools, products, and services, to offer customers a curated shopping experience. Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services.

These Terms of Service, together with the policies referenced within them, explain your rights and responsibilities when using our website or Services.

Please read these Terms of Service carefully, as they contain important information about your legal rights, including warranty disclaimers and limitations of liability. SECTION 1 – ELIGIBILITY AND ACCOUNTS

Garment measurements and sizing information are approximate. Customers are responsible for reviewing the available product and size information before ordering.

TIME Movement products may be released in limited quantities or as part of specific chapters, collections, or drops. Product availability, replacement sizes, colors, and exchanges are not guaranteed.

We reserve the right to modify, limit, discontinue, or replace products without notice. We may also limit product quantities available to any person, household, geographic region, or order when reasonably necessary.

SECTION 3 – ORDERS AND ACCEPTANCE

Submitting an order constitutes an offer to purchase. An order is not accepted until payment is successfully processed and we confirm that the ordered products are available.

Please review your order carefully before submitting it. We may be unable to change or cancel an order once it has entered processing or has been shipped.

We reserve the right to refuse, limit, or cancel an order for reasons including suspected fraud, unauthorized payment activity, pricing or inventory errors, product unavailability, unusually large quantities, suspected resale activity, or a violation of these Terms.

If we cancel an order after payment has been processed, we will issue a refund to the original payment method for the canceled portion.

We will attempt to contact you using the email address, phone number, or billing information provided with your order if an issue arises.

SECTION 4 – PRICES, PAYMENTS, AND TAXES

Prices are displayed in United States dollars unless otherwise stated. Prices, discounts, and promotions may change without notice, but changes will not affect an order that has already been accepted and paid.

Applicable taxes, shipping charges, and other required costs will be displayed during checkout before you complete your purchase.

You agree to provide valid and authorized payment information. By submitting an order, you authorize us and our payment processors to charge the total amount displayed at checkout.

Promotional offers and discount codes may have separate conditions, expiration dates, exclusions, or minimum-purchase requirements. Unless otherwise stated, promotional offers cannot be combined.

If a pricing or product-information error affects your order, we may contact you for instructions or cancel the affected portion and provide a refund.

SECTION 5 – SHIPPING AND DELIVERY

TIME Movement currently ships within the United States only.

Delivery dates are estimates and are not guaranteed. Delays may occur because of carriers, weather, holidays, incorrect addresses, service interruptions, or other circumstances outside our reasonable control.

Customers are responsible for entering a complete and accurate shipping address. Contact us as quickly as possible if you notice an error. We cannot guarantee that an address can be changed after an order enters processing.

If a package is returned because of an incorrect address, failed delivery, refusal, or another issue caused by information provided by the customer, additional shipping costs may apply before the order can be resent.

Responsibility for loss or damage during shipment will be determined according to applicable law, the circumstances of the shipment, and the applicable carrier’s policies.

SECTION 6 – RETURNS, EXCHANGES, AND REFUNDS

Returns, exchanges, and refunds are governed by our Return and Refund Policy:

Eligible returns must be requested within the return window and meet the conditions described in that policy. Items returned without first contacting us or items that do not meet the return requirements may be refused.

Because TIME Movement products may be limited releases, exchanges and replacement sizes or colors are not guaranteed.

Original shipping charges are nonrefundable unless required by law or unless the item arrived damaged, defective, or incorrect.

Approved refunds will be issued to the original payment method. The time required for a refund to appear may vary depending on the customer’s bank or payment provider.

Nothing in these Terms limits consumer rights that cannot legally be waived.

SECTION 7 – DAMAGED, DEFECTIVE, OR INCORRECT ITEMS

Please inspect your order after delivery.

If an item arrives damaged, defective, or incorrect, contact us within seven days of delivery at today@time-movement.com.

Include your order number, a description of the issue, and clear photographs of the item and packaging when applicable.

We will review the information and determine an appropriate resolution, which may include a replacement, store credit, refund, or another remedy required by applicable law.

SECTION 8 – INTELLECTUAL PROPERTY

The TIME Movement name, clock-and-cross logo, website design, photographs, graphics, written content, product designs, slogans, videos, audio, and other original materials are owned by or licensed to Mount Up LLC unless otherwise stated.

“Today, It Means Everything®” is a registered trademark used by TIME Movement.

You may not reproduce, copy, distribute, modify, sell, license, publish, display, exploit, or create derivative works from our intellectual property without prior written permission.

Purchasing a product does not transfer ownership of any trademark, copyright, design, or other intellectual-property right.

Shopify’s names, logos, products, and services remain the intellectual property of Shopify or its licensors. Other third-party names, logos, and content belong to their respective owners.

SECTION 9 – CUSTOMER REVIEWS, FEEDBACK, AND PERSONAL STORIES

If you voluntarily submit a product review, comment, suggestion, or general feedback, you confirm that you have the right to submit it and that it does not violate another person’s rights.

You grant us a nonexclusive, worldwide, royalty-free license to display, reproduce, edit for clarity or formatting, and use submitted reviews, comments, suggestions, or general feedback in connection with operating and promoting TIME Movement.

This general license does not automatically authorize us to publish or use a personal story, private message, photograph, video, voice, or likeness in advertising or promotional materials.

Personal stories submitted through a TIME Movement story feature may be reviewed, edited for clarity, declined, or held for future consideration. Submission does not guarantee publication. When appropriate, we will obtain the permission described with the submission or request separate authorization before publicly sharing a personal story, photograph, video, voice, or likeness.

We will not knowingly claim ownership of your personal story.

You may not submit content that is unlawful, abusive, threatening, defamatory, misleading, obscene, malicious, or infringing upon another person’s intellectual-property, privacy, publicity, or other rights.

SECTION 10 – THIRD-PARTY SERVICES AND LINKS

Our online store is hosted by Shopify. Shopify provides the ecommerce platform that allows us to offer products and Services to you.

We may use third-party providers for services including payment processing, shipping, email, analytics, customer support, marketing, and website functionality. Your use of certain third-party services may also be subject to their applicable terms and privacy practices.

Our website may contain links to websites operated by third parties. We are not responsible for the content, accuracy, availability, security, products, services, or practices of third-party websites.

Accessing a third-party website is at your own discretion. Questions or disputes concerning a third-party product or service should be directed to the applicable third party.

SECTION 11 – RELATIONSHIP WITH SHOPIFY

TIME Movement is powered by Shopify, which enables us to provide our online store and Services.

Purchases made through our store are transactions directly between the customer and Mount Up LLC under the TIME Movement brand. Shopify is not the seller of TIME Movement products and is not responsible for fulfilling orders, processing returns on our behalf, or resolving product-related concerns.

Nothing in these Terms creates an employment, agency, partnership, or joint-venture relationship between Shopify and Mount Up LLC or TIME Movement.

This section does not require indemnification for conduct caused solely by Mount Up LLC or TIME Movement when such a requirement would be prohibited by law.
